Falck compensates losses in competition case

Falck has reached a settlement regarding payment of compensation for losses resulting from the acts in 2014-15, which led to the ruling of the Competition Council earlier this year against Falck for violation of the competition rules.

The settlement is made between Falck, the Region of Southern Denmark, the Dutch owners of BIOS and the bankruptcy estate of BIOS in Denmark. Falck has agreed to compensate the parties with a total amount of DKK 152.5 million.

Falck has made separate agreements for compensation with the Region of Southern Denmark, the Dutch owners of BIOS and Rabobank. Hence, the parties have withdrawn their claims against the bankruptcy estate of BIOS in Denmark.

Around 500 minor creditors will be covered by the bankruptcy estate with an amount which as matters stand is considered sufficient to ensure payment of the known claims against the bankruptcy estate.

With the settlement agreement, the parties waive any further claims and all litigations between the parties will be withdrawn.

President and CEO of Falck, Jakob Riis, says:

“In 2014-15, Falck acted in a way that was unacceptable and which we will never repeat. We have accepted the ruling by the authorities. We have worked to create a joint solution for both large and small creditors. We are happy that we have reached a settlement and will now pay the parties’ losses.

As new management, we want to ensure that we will never experience such matter again. The settlement is another important step in our clean-up”.

The settlement agreement is subject to confidentiality between the parties and therefore no further details will be disclosed.
